Your use of our Services or visiting https://www.realworklabs.com (our “Website”) constitutes your acceptance of this privacy policy, our Terms & Conditions and any terms agreed upon by you and RealWork, including but not limited to subscription agreements for our Services. You are responsible for regularly reviewing these terms, and your continued use of the Website and Services after updates to this privacy policy has been posted constitutes your consent to such updated terms.

This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this Website and our Services after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates. 

Who this Privacy Policy Applies To

  • "RealWork Customers": companies and other entities that have contracted with RealWork for the Services. In cases where this Privacy Policy is used in the context of handling a Customer’s personal information, it refers to the Customer that is an individual.

  • "RealWork Users": employees, contractors, and any other users (including but not limited to third-parties like marketing agencies) whom a RealWork Customer has authorized to access the Services on its behalf.
  • "Consumers": individuals who are current or potential RealWork Customers, RealWork Users, customers and prospective customers of RealWork Customers, and visitors to RealWork Customers’ websites.
  • "Website Visitors": anyone who accesses our Website, https://www.realworklabs.com.

In this Privacy Policy, "you" and "your" refers to you, the reader. What types of information we collect and how we handle such personal information will depend on whether you are a RealWork Customer, RealWork User, Consumer, or Website Visitor.

Information We Collect About You and How We Collect It

What personal information we collect depends on the nature of your relationship with RealWork and your use of the Services. While some information may be collected automatically or through third-party sources, most is collected when you use our Services. The information we collect in these different cases is summarized below:.

Personal Information Provided to Us

Information Collected from RealWork Customers and RealWork Users

In conjunction with your subscription and use of our Services we collect personal information including:

  • Name.
  • Business address and other general location details.
  • Contact details, such as your phone number and email.
  • Job Title.
  • Content of communications and correspondence with RealWork sales and support teams including text messages, emails, message attachments, and call transcripts.
  • Your responses to surveys that we might ask you to complete for research purposes.
  • As part of the 10 DLC registration process for dedicated business phone numbers, we may also collect your employer identification number (EIN). 
     
Information Collected from and about Consumers

If you are a Consumer, we collect information from you through your use of the Services, which may include your use or engagement with our widgets, visiting RealWork Customer websites, review requests from RealWork Customers, and other related products. 

Depending on the Services you use, We may collect or receive your personal information including your:

  • Name.
  • Contact details, such as your phone number and email.
  • Address and other general location details.
  • Reviews and feedback in relation to your experience with RealWork Customers (if you choose to provide it).

As part of the delivery of our Services, we receive information from our Customers about the jobs that they perform for their customers. This information includes:

  • Address and other general location details pertaining to where the job was performed.
  • The name of the primary contact (homeowner or other person the services were performed for).
  • The contact details for the primary contact such as phone number and email.
  • Media including photos and videos of the work and site where the work was performed.
Information Collected from Website Visitors


We may also collect personal information from you when you visit our Website to browse, request information about our Services, schedule a product demo, fill in a form, or you subscribe to our social media channels (e.g., Facebook, LinkedIn, etc.). This personal information may include your:

  • Name.
  • Contact details, such as your phone number and email.
  • Business name.
  • Business Website.
  • Job Title.

We collect certain information automatically whenever anyone uses our Services or visits our Website - whether you are a RealWork Customer, RealWork User, Consumer, or Website visitor.


Usage Details


When you access and use the Website or the Services, we may automatically collect certain details of your access to and use of the Service, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Website.


Website Widget Session Data on RealWork Customers’ Websites


RealWork Customers’ websites may integrate our widgets. When you visit a site with an embedded RealWork widget, We receive certain information about you, including information about the web page you visited, other information about your device, and as allowed by your browser settings, your location.

Device Details

We receive information about the device and software you use to access our Services, such as your internet protocol (IP) address, web browser type, operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, and push notification tokens.

Third-Party Account Integrations

If you choose to link our Services to a third-party account, We may receive information about you from that third party, including your profile information, photo, and use of that account. If you choose to link a Google account to our Services, our use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy. When a Consumer leaves a public review on Google or Facebook for a RealWork Customer, we will have access to the review content and the public profile name and photo for the associated account belonging to the Consumer that left the review.

Automatic Data Collection Technologies that We Use

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website.   • Web Beacons. Pages of our Website and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit RealWork, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

Information Collected from Other Sources

We may also collect information about you that is publicly available. For example, We may source information about a business from public search pages, or receive information about you if you interact with us or share your information through various social media channels.

How We Use Your Information

We use your personal information to provide you and RealWork Customers with our Services and to manage our business operations. This includes communicating with you as part of our Services, as well as use for advertising and marketing purposes and as otherwise permitted by law. The nature of how we use personal information will depend on the specific Services you use, and may vary depending on whether you are a RealWork Customer, RealWork User, Consumer, or Website visitor. Ways in which we use or may use this information is summarized below.

  • To provide you with our Services and support and training related to our Services.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To analyze the performance and assess the effectiveness of our Services.
  • To create and develop analytics for the benefit of our business and the businesses of RealWork Customers.
  • For research purposes, including the improvement of existing offerings and the development of new offerings.
  • To determine eligibility for and submit registrations for certain services (e.g. 10 DLC phone numbers).
  • To send marketing communications via email or otherwise contact you regarding existing or new features related to our Services.
  • To run display advertisements for RealWork on social media and other third-party ad platforms. 
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.
RealWork Customer Job Information

The website widgets included in our Service display RealWork Customer’s job-related content which may include personal information such as the approximate location of the worksite which may be a private residence, photos and videos of the worksite and work that was performed, and in cases where a public review has been left on Facebook, Google, or directly through our platform, the public profile name and photo of the reviewer’s account as well as the review content.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. 

We may disclose Personal Information that we collect or you provide:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of RealWork’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by RealWork about our Website and Services, RealWork Customers, and Consumers is among the assets transferred.

  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.

  • To enforce or apply our Terms & Conditions and other agreements, including for billing and collection purposes.

Your Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the Personal Information you provide to us. There are mechanisms you can use to have control over your information:

  • Tracking Technologies and Advertising. There are ways to control and/or reject the setting of cookies and similar technologies within your browser settings. As each browser is different, please consult the “help” menu within your browser. For additional information about cookies and how to control their use on various browsers and devices, you can visit http://www.allaboutcookies.org. Please be aware that depending on the Services being used, restricting cookies may prevent you from accessing and using all or part of the Services.

Do Not Track (“DNT”) is an optional browser setting that allows you to express your preferences regarding tracking across websites. Outside of the opt-out preference setting described below, we currently do not respond to DNT signals and we may continue to collect information in the manner described in this Privacy Policy from browsers that have enabled DNT or similar mechanisms.

  • Disclosure of Your Information for Third-Party Advertising. RealWork does not “sell” your personal information to unaffiliated or non-agent third parties. We may however, provide personal information collected from marketing pages on our Website to third parties for the purposes of displaying advertisements for RealWork on other platforms according to advertisers’ target audience preferences (“targeted advertising”). We may also allow certain third-party advertising partners to use cookies and other tracking technologies on our Services to collect information about you and your online activities for targeted advertising. The information they may collect could include your personal information or information about your online activity over time across different websites and other online services. This information may be shared with other ad networks and other content providers. If we implement such targeted advertising in the future, you may be able to opt out through a cookie management tool that could be accessed through links in our Website. Please note that this opt out will require you to have cookies enabled on your browser and will only apply to the specific device and browser you use when you opt out.

We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

  • Disclosure of Your Information for Third-Party Advertising. RealWork does not “sell” your personal information to unaffiliated or non-agent third parties. Managing Your Information


RealWork Customers and RealWork Users

The personal information related to your account is provided by you and it is your responsibility to ensure that it is accurate, complete, and up to date. If this information is inaccurate, incomplete, or out of date we ask that you notify us or update the information directly by logging into your account. If you wish to delete your personal information that you have provided us or that we have collected, you may email us with a request at privacy@realworklabs.com. To ensure proper handling of this request, we will need to verify your identity. We may not accommodate a request to change or delete all of your information if we believe the change would violate any law, a legal or contractual requirement, a technical limitation, or cause the information to be incorrect. Additionally, we cannot delete all of your personal information except by also deleting your user account.

Consumers

As a software platform providing Services to RealWork Customers and RealWork Users, we generally act as a data processor on their behalf. When we collect or process information pertaining to Consumers through the provision of our Services, such as names, contact details, address information, and job details including media, we do so on behalf and as directed RealWork Customers through their use of our Services. If you wish to access, modify, or delete any personal information or content collected by our Services or displayed on our Website widgets, you should first direct your request to that RealWork Customer. 

You may also send an email to privacy@realworklabs.com with your request related to such information. We may ask that you provide a proof of identity with your request to prevent any fraudulent activity. We will respond to your request within the time period required by law. If we cannot process your request we may inform you of the reasons why, subject to any legal or regulatory restrictions, and outline further steps available to you.

Data Security

We have implemented reasonable measures designed to protect the information we maintain and secure it from accidental loss and from unauthorized access, use, alteration, and disclosure including the use of reputable third party technology providers to store and secure such information on our behalf. 

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website or Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website or Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website or Services.

Children Under the Age of 18

Our Website and Services are not intended for children under 18 years of age. No one under age 18 may provide any personal information to the Website or through our Services. We do not knowingly collect personal information from children under 18.
